Session Agreement

This agreement is between Shannon's Photography, LLC ("We, Us, Company") and ("You, Client").

Session Fee
All session fees are to be paid in full seven days after confirmation of booking, unless the session falls within 10 days of booking, sales, or promotions then payment is due immediately. Invoices will be sent to the email provided in the booking request, where they can be paid by Debit/Credit/ACH only. Cash and personal checks are not accepted.

Mini-Sessions: Payment is due at the time of booking.

Wedding Client Only
Minimum $500 deposit to secure date paid within seven days of confirmed booking. Balance must be in accordance with agreed upon payment schedule. All deposits are non-refundable non-transferable if you should cancel or change your date.

All Inclusive
The session is all inclusive, no additional fee is required. Professional prints can be ordered through your session album (no prints are included with your session).

Photo Rights
All photos are copyright Shannon's Photography, LLC- we release only print rights which allows you to print them unlimited times.

Delivery
Photographs are delivered electronically via a secure online album to the email address at the time of booking. These files are uploaded at full resolution so download sizes may be large. Delivery requests for other methods are available for an additional fee using approved media, customer purchase media is not accepted. However; you are more than welcome to download them and store them on any type of media you wish.

Digital Retention
Although we try to keep your photos available for as long as possible, we do not guarantee the retention of your photos 90 days after your session. Please download your photos accordingly and keep them in a very safe place.

Timeline
Professional photos require a great deal of time and effort, I promise that we work as quickly as possible, but there is no guaranteed turnaround time.

We cannot make any guarantee to products ordered from our professional print labs.

Pricing, promotions, and services subject to change at anytime.

During your session
I want you to have the most unique photos possible. I encourage props, clothing, etc. but do prohibit the use of any electronic devices, including but not limited to, cell phones, cameras, etc.

Location & Travel
You are responsible for the cost and booking of any locations not owned by Shannon's Photography, LLC. There is a travel fee ($100/hour of travel time in addition to the current year mileage rate/mile round-trip) for any location(s) 20+ miles away from my studio. Mileage calculated both ways. For wedding sessions, a mileage charge and two night accommodations will be added onto the wedding package of choice.

*Please note no public bathroom on the premises available.

Timeliness & Cancellations
I plan my schedule accordingly, if you are more than 15 minutes late I consider your appointment abandoned and the entire session fee is forfeited.

In the event you must cancel the session for any reason, you will forfeit 50% of the session fee if you notify me in writing 48hrs prior to the scheduled time. Notices given after the 48hr grace period, will forfeit the entire session fee. Rescheduling is considered a cancellation and subject to the same policy.

Forfeiture's are non-transferable, any money owed to you will be in the form of session credit. No refunds.

**Please note If during your session an event occurs like an uncooperative child or anything else that should prevent us from finishing a session, than you would have to pay 50% of your session fee for an additional partial session to fulfill your session time**

Client Closet: Active July 1, 2022
Upon entering the studio you will notice that I have a client closet with a wide variety of outfits for newborn, children and women. All outfits size 18 months and up and will be subject to a $25-50 cleaning/outfit fee. If you should decide the day of your session to borrow one, no worries. I can send an invoice to you for the cleaning fee however note that you will not see a preview of any images until the invoice has been paid for in full. Thank you all for understanding this policy. Many of these require a very delicate cleaning process.

Privacy Policy
We will never sell your information to third-parties. However; I retain the right to hold your information for business records and any marketing purposes we see fit. If you wish to opt-out of marketing campaigns please email me directly so I can remove you from my list.

Copyright & Penalties
It is prohibited to use photography produced by Shannon's Photography, LLC for any other purpose other than personal use. We do not permit the use of any photography for commercial use, unless prior written permission is obtained.

Third Parties
We reserve the right, at our expense, to utilize third parties for delivery of your photos. This may include, but is not limited to, photo editing, printing, and other services. Of course your privacy is very important and all third-parties are contracted and required to follow a strict confidentiality agreement.

Markings, Tattoo's, etc.
Children (or adults) found with tattoo's (temporary or permanent), glitter, paint, markers or other markings will not be edited out. It is important to have any markings you do not wish to have in the final photograph removed prior to the session.

Model & Photo Release
We love to show off our work, contracting with us gives us all exclusive rights to use the photos for any purposes we see fit on all forms of marketing (digital, print, etc.), including Social Media, for as long as we see fit.

We hold the right to use your photos, name (including family name), and any minor children listed in the session for any marketing purposes we see fit.

Signature and booking of this session is your legal consent to this agreement, you release Shannon's Photography, LLC from any damage or compensation in connection with your session photos.

Legal Stuff
This agreement cannot be transferred to anyone else without our permission. Provisions of this agreement found unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

Although the language is simple, the intentions are serious and this contract is a legal document under exclusive jurisdiction of the courts in the State of Michigan. In the event of dispute, both parties agree to bare their own legal costs and attorney's fees.
